TERMS & CONDITIONS OF ENTRY

1. Acceptance

1. I agree and undertake that I shall be bound by and comply with these terms and conditions of entry (“terms and conditions”) to the PEP/Snap-e treasure hunt Competition (“the Competition”). I understand and agree that in the event that I fail to comply with these terms and conditions for any reason that my entry shall be deemed invalid and I shall be automatically disqualified from the Competition without further notification to myself. Whether there has been a failure to comply with these terms and conditions shall be decided at e.tv’s sole discretion, and shall be final and binding upon myself.

1. Definitions

1. “PEP” means Pep Stores, Pep Home and Pep Cell as Division of Pepkor Trading (Pty) Ltd with registration number 1958/003362/07, and is only applicable to South African stores.

1. “Duration” means 17h00 on Monday, 7 October 2024 until 22h00 on Sunday, 3 November 2024.

1. “e.tv” means e.tv (Pty) Ltd with registration number 1997/012816/07;

1. “POPI Act” shall mean the Protection on Personal Information Act 4 of 2013;

1. “Personal Information” shall have the meaning as defined in the Act;

1. “Snap-e” means the Snap-e app / application which allows users to access certain content and rewards via their mobile device and a television advertisement interface.

1. “Week” means Week 1; or Week 2; or Week 3; or Week 4 as the context indicates and “Weekly” will have a corresponding meaning. 

1. “Week 1” means 17h00 on Monday, 7 October 2024 until 22h00 on Sunday, 13 October 2024.

1. “Week 2” means 17h00 on Monday, 14 October 2024 until 22h00 on Sunday 20 October 2024.

1. “Week 3” means 17h00 on Monday, 21 October 2024 until 22h00 on Sunday 27 October 2024.

1. “Week 4” means 17h00 on Monday, 28 October 2024 until 22h00 on Sunday 3 November 2024.

1. Introduction

1. In order to be able to enter the Competition and to be eligible to comply with these terms and conditions, it is a condition that the person must be a resident of South Africa and 18 years of age or older.

1. The promoter of the Competition is e.tv on behalf of PEP. Any person who is an employee of eMedia Investments, e.tv, PEP or any of their affiliated companies and/or any other agent, promoter and/or other person connected with the Competition and/or a member of their family, shall not be allowed to enter the Competition and shall be ineligible to participate. If any such person should enter then they will be automatically disqualified.

1. e.tv shall be entitled at its sole discretion to declare any entry as invalid or disqualified, and shall not be obliged to provide a reason for such invalidity or disqualification to such entrant, nor shall it be liable for any damages in law.

1. All decisions of e.tv shall be final and binding and e.tv shall not be required to enter into any correspondence, dialogue and/or otherwise with any person regarding any aspect of the Competition.

1. The terms and conditions of this Competition shall be subject to the laws of South Africa and you consent to the jurisdiction of the High Court of South Africa, Gauteng Local Division in respect of all matters arising out of or in connection with the Competition.

1. If any provision of these terms and conditions is found to be invalid or unenforceable by any court of competent jurisdiction, then that provision shall be severed from these terms and conditions and shall not affect the validity or enforceability of any remaining provisions.

1. It is not intended that any provision of these terms and conditions contravenes any provision of the Consumer Protection Act, 68 of 2008, and therefore all provisions of these rules must be treated as being qualified, if necessary, to ensure that the provisions of the Consumer Protection Act are complied with.

1. Prize(s) and Duration of Competition

1. The prize(s) shall consist of PEP vouchers worth R750 000 in total.

1. The breakdown of such prizes is as follows for persons who collect all 5 unique weekly markers; and who are entered into a random selection draw and subsequently selected as a winner (a person may only win one prize per Week):
   1. 35 x R5000 PEP vouchers for the winners of the Week 1 random draw, redeemable at PEP.
   2. 35 x R5000 PEP vouchers for the winners of the Week 2 random draw, redeemable at PEP.
   3. 35 x R5000 PEP vouchers for the winners of the Week 3 random draw, redeemable at PEP.
   4. 35 x R5000 PEP vouchers for the winners of the Week 4 random draw, redeemable at PEP.

1. The breakdown of such prizes is as follows for persons who collect all 5 unique weekly markers and the PEP bonus marker; and who are entered into a random selection draw and subsequently selected as a winner (a person may only win one prize per Week):
   1. 1 x R10 000 PEP voucher for the winner of the Week 1 random draw, redeemable at PEP.
   2. 1 x R10 000 PEP voucher for the winner of the Week 2 random draw, redeemable at PEP.
   3. 1 x R10 000 PEP voucher for the winner of the Week 3 random draw, redeemable at PEP.
   4. 2 x R10 000 PEP vouchers for the winners of the Week 4 random draw, redeemable at PEP.

1. The Competition start date is 17h00 on Monday, 7 October 2024 and the end date is 22h00 on Sunday, 3 November 2024.

4.5          The promoter reserves the right to amend these dates if required by updating these terms and conditions. 

1. Entry into the Competition:
   1. In order to enter the Competition, an entrant must:
      2. Download Snap-e on the Apple App Store, Google Play Store or Huawei App Gallery (you will need to incur data or WiFi charges in downloading Snap-e, which will solely be for your account);

2. register a profile on Snap-e with your full details.

2. agree to the Snap-e terms and conditions and the Snap-e privacy policy.

1. For the Duration of the Competition, look out for the Week 1-Week 4 unique markers and PEP bonus marker. 
   1. Open Snap-e, and scan for the applicable Weekly unique markers on e.tv, eExtra, eReality, eMovies, and eMovies Extra from 17h00-22h00 . 

1. collect all 5 applicable Weekly unique markers on screen and/or the PEP bonus marker. 

1. Upon scanning your first the applicable marker, you will receive a Competition entry form (you will not be required to complete such Competition entry form upon your collection of subsequent unique markers) where you will be required to submit your details which may include but not be limited to your name; surname; age; contact details; mobile number; email address; location information, and any other Personal Information as may be required in e.tv’s discretion for the purpose of the Competition. 

3. You may be required to confirm and submit that you are a valid South African resident; are 18 or above and agree to Competition terms and conditions that are linked on the Competition entry form.

3. You will receive confirmation from Snap-e that your entry has been submitted. 

3. You may not enter the Competition including by means of using multiple devices or through means of sharing links with third parties. You may enter the Competition multiple times with different markers.

3. The scanning of markers for the Competition may only occur within the Competition start and end date and all entries must be completed within the Competition start and end date.

3. No entries will be accepted that are incomplete or which are delayed beyond the Competition end date.

3. An individual may only win one prize for each Week of the Competition, regardless of which random selection draw they are entered into.

3. In the event that an individual is selected as a winner, they will be notified through Snap-e and the winners’ full names will be announced on e.tv, eExtra, eReality, eMovies, and eMovies Extra every Monday evening between from 17h00pm-22h00 for the Duration of the Competition. 

3. Prizes can only be awarded and/or taken by the person whose name is provided at the time of entry to the Competition. 

3. Prizes are not transferable for alternate prizes or cash. Prizes need to be redeemed within the period permitted for redemption which will be communicated to you should you be selected as a winner.

3. e.tv and PEP and their affiliates will not be responsible for any harm, damage, loss or claim relating to the provision of any prizes or any changes to a prize that may be made.

1. Changes to terms and conditions
   1. e.tv reserves the right at its sole discretion to withdraw and/or substitute any prize at any time for any reason. e.tv may replace and/or substitute any prize with any products, goods, services and/or cash which it decides is appropriate in the circumstances.

1. e.tv may at any time decide to change, cancel, amend, vary, delete, add to, and/or otherwise alter the terms and conditions, the prizes and/or any other part of the Competition.

1. Personal Information
   1. You acknowledge and agree that by entering the Competition, you will be providing your Personal Information to e.tv and PEP.

1. You hereby consent to the processing of your Personal Information for the purpose of operation of the Competition. Your Personal Information will be held by e.tv and shall be processed according to the Snap-e privacy policy and/or e.tv privacy policy, except where otherwise provided for in these terms and conditions.

1. Force majeure
   1. Where for any reason beyond the reasonable control of e.tv or Snap-e the Competition cannot be carried out and/or completed as planned and/or advertised due to a force majeure event, then e.tv reserves the right to cancel the Competition in such event and shall not be liable to any person.

1. Publicity
   1. Winners give their consent for their full names and associated prizes to published by e.tv and eMedia Investments and their associated channels and digital platforms inclusive of websites and social media.

1. Winners’ full names shall be announced on e.tv, eExtra, eReality, eMovies, and eMovies Extra and any other platforms that e.tv and eMedia Investments deem fit.

1. The sharing of content by e.tv or eMedia Investments online or otherwise does not signify that a participant has won the competition.
