  1. I agree and undertake that I shall be bound by and comply with these terms and conditions of entry (“terms and conditions”) to the Clicks Snap-e Competition (“the Competition”). I understand and agree that in the event that I fail to comply with these terms and conditions for any reason that my entry shall not be eligible and I shall be disqualified from the Competition. Whether there has been a failure to comply with these terms and conditions shall be decided in e.tv’s sole discretion, and shall be final and binding upon myself. 

 

2. Definitions 

  1. 2.1  “Clicks” shall means Clicks Retailers (Pty) Ltd; 
  2. 2.2  “e.tv” means e.tv (Pty) Ltd; 
  3. 2.3  “POPI Act” shall mean the Protection on Personal Information Act, 2013; 
  4. 2.4  “Personal Information” shall have the meaning as defined in the Act; 
  5. 2.5  “Snap-e” means the Snap-e App / Application which allows users to access certain content and rewards via their mobile device and a television advertisement interface. 

 

3. Introduction 

  1. 3.1  In order to be able to enter the Competition and to be eligible to comply with these terms and conditions, it is a condition that the person must be a resident of South Africa and 18 years of age or older. 
  2. 3.2  The promoter of the Competition is e.tv on behalf of Clicks. Any person who is an employee of e.tv or any of its affiliated companies and/or any other agent, promoter and/or other person connected with the Competition and/or a member of their family, shall not be allowed to enter the Competition and shall be ineligible to participate. If any such person should enter then they will be automatically disqualified. 
  3. 3.3  e.tv shall be entitled at its sole discretion to declare any entry as invalid or disqualified, and shall not be obliged to provide a reason for such invalidity or disqualification to such entrant, nor shall it be liable for any damages in law. 
  4. 3.4  All decisions of e.tv shall be final and binding and e.tv shall not be required to enter into any correspondence, dialogue and/or otherwise with any person regarding any aspect of the Competition. 
  5. 3.5  The terms and conditions of this Competition shall be subject to the laws of South Africa and you consent to the jurisdiction of the High Court of South Africa (Gauteng Local Division) in respect of all matters arising out of or in connection with the Competition. 
  6. 3.6  If any provision of these terms and conditions is found to be invalid or unenforceable by any court of competent jurisdiction, then that provision shall be severed from these

terms and conditions and shall not affect the validity or enforceability of any remaining provisions. 

3.7 It is not intended that any provision of these terms and conditions contravenes any provision of the Consumer Protection Act, 68 of 2008, and therefore all provisions of these rules must be treated as being qualified, if necessary, to ensure that the provisions of the Consumer Protection Act are complied with. 

 

4. Prize(s) and Duration of Competition 

4.1 The prize(s) shall consist of Clicks’ gift cards, shopping spree experiences, homeware items, personal care gifts and Safeway Vantage Systems to the value of R250 000. The breakdown of such prizes is as follows: 

  1. 4.1.1  265 gift cards 
  2. 4.1.2  2 shopping spree experiences. 
  3. 4.1.3  55 homeware items. 
  4. 4.1.4  5 Safeway Vantage Systems. 
  5. 4.1.5  22 personal care gifts. 

4.2 The competition start date is 9:00am on 15 November 2024 and the Competition end date is 23.59 on 13 Dec 2024. 

 

5. Entry into the Competition: 

5.1 In order to enter the Competition, an entrant must: 

  1. 5.1.1  Own a valid Clicks ClubCard. In order for an entry to be considered valid, an entrant’s name, surname and identity number must match the ClubCard number that Clicks have on their internal system. 
  2. 5.1.2  Download Snap-e on the Apple App Store, Google Play Store or Huawei AppGallery (you will need to incur data or WiFi charges in downloading Snap-e, which will solely be for your account). 
  3. 5.1.3  Register a profile on Snap-e with your full details. 
  4. 5.1.4  Agree to the Snap-e terms and conditions and the Snap-e privacy policy. 
  5. 5.1.5  For the month of November & December 2024, look out for Snap-e markers with a “SNAP, CLICK & WIN!” call to action label on the following channels: e.tv, eExtra, eMovies, eMovies Extra, eReality, eSeries, ePlesier, eToonz. 
  6. 5.1.6  Open Snap-e, and scan the marker on screen. Upon scanning the marker, you will receive a Competition entry form where you will be required to submit your details including your name; surname; age; contact details; mobile number; email address; location information, and any other Personal Information as may be required in e.tv’s discretion for the purpose of the Competition.

  1. 5.2  You will be required to confirm and submit that you are a valid South African resident; are 18 or above and agree to these Competition terms and conditions that are linked on the Competition entry form. 
  2. 5.3  You will receive confirmation from Snap-e that your entry has been submitted with proof of entry via a Competition entry code which will be received via Snap-e. 

  3. 5.4  * **Multiple Entries:** You may scan the Snap-e markers multiple times to increase your chances of winning.

  5. 5.5  The scanning of markers for the Competition may only occur within the Competition start and end date and all entries must be completed within the Competition start and end date. 
  6. 5.6  No entries will be accepted that are incomplete or which are delayed beyond the Competition end date. 
  7. 5.7  Multiple people may win a prize linked to a specific marker. However, an individual may only win one prize per marker. 
  8. 5.8  Prizes can only be awarded and/or taken by the person whose name is provided at the time of entry to the Competition. Prizes are not transferable for alternate prizes or cash. 
  9. 5.9  e.tv and Clicks and their affiliates will not be responsible for any harm, damage, loss or claim relating to the provision of any prizes or any changes to a prize that may be made. 

 

6. Changes to terms and conditions 

  1. 6.1  e.tv reserves the right at its sole discretion to withdraw and/or substitute any prize at any time for any reason. e.tv may replace and/or substitute any prize with any products, goods, services and/or cash which it decides is appropriate in the circumstances. 
  2. 6.2  e.tv may at any time decide to change, cancel, amend, vary, delete, add to, and/or otherwise alter the terms and conditions, the prizes and/or any other part of the Competition. 

 

7. Personal Information 

  1. 7.1  You acknowledge and agree that by entering the Competition, you will be providing your Personal Information to e.tv and Clicks. 
  2. 7.2  You hereby consent to the processing of your Personal Information for the purpose of operation of the Competition. Your Personal Information will be held by e.tv and shall be processed according to the Snap-e privacy policy, except where otherwise provided for in these terms and conditions.  
  3. 7.3  You hereby consent to Clicks and their necessary agents and contractors having access to your Personal information for the purposes of marketing, direct marketing and furthering their business interests and objectives. Clicks and their necessary agents and contractors will have access to reports and information that reflect metrics relating to the Competition.

8. Force majeure 

8.1 Where for any reason beyond the reasonable control of e.tv or Snap-e the Competition cannot be carried out and/or completed as planned and/or advertised due to a force majeure event, then e.tv reserves the right to cancel the Competition in such event and shall not be liable to any person.

 

9. Publicity 

9.1 Winners shall have their names and associated prizes published by e.tv on its channels and digital platforms inclusive of websites and social media.
